This campaign supports my independent volunteer advocacy, investigative work, public education efforts, and push for criminal justice reform. It will fund public transparency efforts, civil rights awareness campaigns, documentary and media production, records requests, and systemic reform aimed at preventing wrongful imprisonment and ensuring innocent people have access to the evidence needed to prove their innocence and the system will not profit off of innocents languishing in jail or paying fees.

Because of the nature of the corruption and the widespread conflicts of interest in the system no attorney will take this on anyways. The legal community—particularly in Harris County and throughout Texas—is either complicit in, intimidated by, or financially benefiting from the same system we are trying to reform. That is why this effort must be public, independent, and fearless.

This campaign is designed to bring national attention to these issues, engage media, and urge federal authorities to intervene, because state mechanisms have completely failed. We are calling for a full investigation and long-overdue structural reform of the justice system.


Hi, my name is Eric Sanchez, and I’m asking for your support in a fight that’s bigger than just one man—it’s about dismantling a system that protects misconduct and punishes the truth.

For the last year, I’ve poured every ounce of time, energy, and money I have into investigating and exposing the wrongful arrest and nine-month detention of Mr. Richard Wayne Collins, a 68-year-old man jailed in 2024 without due process, held under a parole warrant on a charge that collapsed once the truth came out.

What I uncovered went far beyond his arrest.

This case is just the tip of the iceberg. It has revealed a multi-decade pattern of misconduct, false evidence, intimidation, and deep-rooted corruption going back to Mr. Collins’s 1978 murder conviction—where court records were tampered with by the judge with the help of his wife (the court reporter), and the trial transcript of the actually convicted capital murder mysteriously vanished after swapping Collins identity into his indictment and forcing Collins to plea guilty for 5 years or take to trial up to a 99 year sentence despite him being the person instrumental in identifying and convicting the true killer.


THIS IS WHAT THEY DID. AND THIS IS WHY I NEED YOUR HELP.

Over the course of this investigation, I uncovered a staggering list of illegal and unethical actions committed by people sworn to uphold justice:


Alleged Crimes and Misconduct Committed:
• False Arrest & Unlawful Detention: Mr. Collins was jailed without probable cause under a “blue warrant” parole hold, violating Morrissey v. Brewer, 408 U.S. 471 (1972).
• Suppression of Exculpatory Evidence: Prosecutors concealed a June 2024 interview where the alleged victim recanted—violating Brady v. Maryland, 373 U.S. 83 (1963), and the Michael Morton Act.
• Subversion of Article 39.14: Prosecutors exploited a loophole by giving Brady material only to a compromised court-appointed attorney who failed to inform his client—bypassing the intent of the law.
• Compromised Counsel: Attorney Jerry Guerinot colluded with the prosecution, saying, “I’m not defending him, just representing him.” He never filed discovery or shared exculpatory material. “Don’t worry we got him on a blue warrant”
• Obstruction of Justice: Prosecutors and the defense attorney worked together to prolong Mr. Collins’s incarceration despite exonerating evidence.
• Conflict of Interest: The lead detective was previously Mr. Collins’s parole officer—an undisclosed and disqualifying conflict.
• Tampering with Government Records (1978): Two indictments exist for the same crime—one altered to include Mr. Collins’s name—possibly in violation of Tex. Penal Code § 37.10.
• Destruction of Public Records: John Henry quinones (the true killer) 1978 trial transcript vanished. The court reporter was the presiding judge’s wife.
• Retaliation Against Me (Whistleblower): I was chased out of the DA’s Office and threatened for trying to submit evidence for his 2024 case.
• Abuse of Holmes v. Morales (1996): Prosecutors are now using this decision to block public access to records and prevent scrutiny.


How the System Was Rigged Against Richard Collins:

The Michael Morton Act was created to prevent prosecutors from hiding exculpatory evidence—but they found a way around it.
• The law only requires prosecutors to give the evidence to the defense attorney, not the defendant.
• Mr. Collins’s attorney was compromised, never disclosed the evidence, and never filed formal discovery.
• Article 39.14 has no penalty for attorneys who fail to inform their clients.
• Mr. Collins was in jail, isolated, unable to seek help, file complaints, or afford a $20,000–$25,000 retainer for private counsel.
• No attorney was willing to argue actual innocence—they only offered to “negotiate” a dismissal without addressing the truth.

This isn’t just bad lawyering. It’s strategic sabotage—a system that protects itself at the expense of the innocent.


A Legal Loophole That Shields Injustice:

Even after the case was dismissed, the Harris County DA’s Office refuses to release the evidence that could prove wrongdoing. Why?

Because of the Holmes v. Morales (1996) loophole, which gives prosecutors absolute discretion to withhold records once a case is “closed.” They are not required to release evidence—even when a life was stolen and the system abused.

This legal loophole has been used for decades to:
• Conceal wrongful convictions
• Prevent civil suits
• Deny access to public records
• Avoid scrutiny and oversight

We intend to change that.


We’re Fighting for More Than One Man:

We’re not just trying to free Mr. Collins—we’re trying to:
• Overturn Holmes v. Morales
• Reform Article 39.14 to require actual access for the accused
• Set legal precedent and push this case to the Texas Supreme Court—or the U.S. Supreme Court, if necessary
• Stop prosecutors from hiding behind loopholes
• Expose misconduct and protect future innocent people from false imprisonment

• Spent thousands of dollars on phone calls, printing, and public records
• Been threatened and chased out of public buildings
• Taken time off work to pursue this full-time
• Gathered and organized 9 months of documented evidence
